Terms of Service

1. Purpose

These Terms of Service ("Terms") govern access to and use of the Lokat platform, accessible via lokat.web.app (and any future equivalent domain). By accessing the site, you accept these Terms in full and without reservation.

2. Definitions

  • Lokat: the marketplace operated by {{COMPANY_LEGAL_NAME}}, connecting property owners and tenants for residential properties located in Senegal.
  • User: any natural or legal person accessing the Lokat website.
  • Owner: a user publishing a rental listing as the lessor.
  • Tenant: a user looking for a property to rent.
  • Property: any residential real estate intended for long-term residential use, located in Dakar (and serviced areas).
  • Lease: a rental contract governed by Decree No. 2023-382.

3. Nature of the service

Lokat is a matching marketplace. Lokat is not a party to the lease contract concluded directly between Owner and Tenant. Lokat provides:

  • A listing publication and verification service;
  • An on-demand video tour service, operated by our partner holding the Carte Professionnelle ({{CARTE_PRO_PARTNER}});
  • ID verification (national ID/passport) of both parties via Smile ID;
  • Secure rent collection via Wave and Orange Money;
  • Automatic generation of rent receipts (quittance) compliant with Senegalese law.

4. Registration and eligibility

Registration is open to any adult natural person (18+) with legal capacity, or to any legal entity duly represented. The user warrants the accuracy of the information provided and undertakes to keep it up to date.

5. Marketplace rules

Every user undertakes to:

  • Publish only listings corresponding to a real property they own or are duly mandated to manage;
  • Provide accurate information (title deed, surface area, equipment, price, photos);
  • Not impersonate a third party;
  • Not use the platform for illicit, fraudulent, or money-laundering purposes;
  • Comply with Decree 2023-382 (security deposit capped at 2 months for unfurnished residential, legal notice periods);
  • Not bypass Lokat for payments after the connection is made (without prior written agreement).

Lokat reserves the right to suspend or remove any account that fails to comply with these rules, without prior notice or compensation.

6. Pricing

6.1 For tenants

Registration and use of Lokat are free for tenants. No agency commission is charged. At lease start, the tenant only pays:

  • The first month's rent;
  • The deposit set by the property owner, within the legal cap of 2 months (Decree 2023-382).

6.2 For property owners

Registration, listing, and rental setup are free. Lokat charges a 2% (two percent) commission on rent actually collected through the platform. This commission is deducted before payout to the owner. No other fee applies.

6.3 Pricing changes

Any change in pricing will be notified by email with a minimum 60-day notice.

7. Deposit and condition report

The deposit is set freely by the owner within the 2-month maximum cap (Decree 2023-382). It is paid directly to the owner (or to a Lokat escrow account when that service is activated). An entry and exit condition report is mandatory and must be signed by both parties.

8. Liability

Lokat acts as an intermediary and cannot be held liable for:

  • Contractual breaches between Owner and Tenant (unpaid rent, damages, refusal to issue receipts, etc.);
  • The accuracy of information provided by users;
  • Indirect damages (loss of opportunity, lost earnings).

Lokat performs reasonable diligence to verify listings and identities, without guaranteeing a result. Lokat is responsible for the technical availability of the website within reasonable limits (excluding force majeure or scheduled maintenance).

9. Intellectual property

The "Lokat" trademark, logo, visual identity, source code, and site architecture are the exclusive property of {{COMPANY_LEGAL_NAME}}. Listings published by owners remain their property but are subject to a non-exclusive license granted to Lokat for the purposes of the matching service.

10. Personal data

Data processing is governed by our Privacy Policy, compliant with Law 2008-12 (Senegal) and the GDPR (EU).

11. Termination

The user may close their account at any time from their settings or by writing to contact@sbcgrow.com. Lokat may suspend or close an account in case of breach of the Terms, without prior notice.

12. Force majeure

Lokat shall not be held liable for any breach resulting from force majeure (natural disaster, civil unrest, major outage of third-party infrastructure, etc.).

13. Mediation and dispute resolution

Any dispute shall first be subject to an attempt at amicable resolution by written exchange (contact@sbcgrow.com). Failing agreement within 30 days, the dispute may be submitted to a mediator.

14. Governing law and jurisdiction

These Terms are governed by Senegalese law and applicable OHADA Uniform Acts. Any dispute shall fall under the exclusive jurisdiction of the courts of Dakar.

15. Amendments

Lokat reserves the right to amend these Terms. Substantial changes will be notified by email to registered users with a minimum 30-day notice.
